Terms of Use

These Terms of Use (the "Terms") govern your use of gis-tools.com. Please read them before using the site. They sit alongside our Privacy Policy and Cookie Policy.

1. About these terms

These Terms govern your access to and use of the website at gis-tools.com and the tools it provides (together, the "Service"). The Service is operated by Yarden Haramati, based in Israel ("we", "us", "our").

By accessing or using the Service, you agree to these Terms. If you do not agree to them, do not use the Service.

Our Privacy Policy and Cookie Policy form part of these Terms.

2. Who may use the Service

You may use the Service only if you are able to form a binding contract with us and are not barred from doing so under any applicable law.

The Service is not directed to children. You must be at least 13 years old to use it. If you are under 18 — or under the age of majority where you live — you may use the Service only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for it, and "you" means that organisation.

3. What the Service is

The Service converts between GIS formats (WKT, WKB, GeoJSON, H3, Lat/Lon and GPS→H3), displays geometry on an interactive map, and provides drawing, import, export and spatial analysis tools.

It runs entirely in your browser. There is no account, no server-side processing of your geometry, and no backend that stores your work.

4. No account, no fee

The Service requires no registration, and we take no payment for it. The core conversion functionality is free and is intended to remain so.

We may in future offer optional paid features alongside the free core. If we do, they will be clearly identified and will carry their own terms. Nothing in these Terms obliges you to pay for anything.

A link to a third-party tipping service ("Buy me a coffee") appears in the navigation. Any tip is voluntary and is handled entirely by that third party under its own terms and privacy policy. A tip is a gift, not a purchase: it buys no entitlement, no support obligation, no service level and no warranty from us. We do not process or receive tips through the Service and cannot refund them.

5. Your data stays with you

Geometry and other data you paste, draw, import or analyse is processed in your browser. It is not transmitted to us, and we do not receive, store or back it up.

Because we never hold your data, we cannot recover it. You are solely responsible for keeping your own copies. Clearing your browser data, using private browsing, switching browser or device, a browser or device failure, or hitting a storage limit can all lose work that you have not exported.

The Service can produce a share link, which encodes your layers in the fragment of a URL — the part after the # symbol. Browsers do not send that part to a server, but anyone holding the link can read the data it carries. Treat a share link exactly as you would treat the data itself.

6. Your responsibilities

You are responsible for the data you put into the Service. You confirm that:

• you are entitled to use it;
• using it in the Service does not breach any law, licence, contract, privacy obligation or duty of confidence that applies to it; and
• it does not infringe anyone's rights.

Where your work builds on OpenStreetMap data, the ODbL's attribution and share-alike terms apply to your derived work — see the Licenses page.

You are responsible for your own equipment, software and internet connection, and for any charges they incur.

7. Acceptable use

You must not:

• use the Service to break any applicable law, or to infringe anyone's rights;
• attack, overload, disrupt, probe, or attempt unauthorised access to the Service or any system or network connected to it;
• do any of the above to the third-party services the Service relies on — including OpenStreetMap's tile servers — or otherwise use the Service in a way that breaches the OSM Tile Usage Policy;
• scrape, crawl or automate use of the Service in a way that degrades it for other users, or place it behind your own automated or bulk-processing service;
• introduce malware or any other harmful code;
• remove, obscure or alter any proprietary notice, attribution or advertising on the Service;
• interfere with the advertising the Service carries, or generate invalid ad traffic; or
• reproduce or rebrand the Service as a competing hosted offering, or otherwise pass our name, branding or content off as your own.

You also confirm that you are not located in, or ordinarily resident in, a country subject to a comprehensive trade embargo that applies to us, and that you are not on any applicable list of restricted or sanctioned parties.

8. Accuracy and known limitations

This section is provided for information, so that you can judge for yourself whether a result is fit for what you need it for. Known limitations of the Service are documented rather than hidden. For example:

• a circle drawn on the map is stored as a 64-sided inscribed polygon, because WKT, WKB and GeoJSON have no circle primitive. That makes its area roughly 0.1–0.3% small, and its vertices are placed with a local flat-earth approximation that drifts for very large circles and near the poles; and
• some export formats cannot carry every attribute or geometry type.

This list is illustrative and not exhaustive. There may be limitations, defects or errors in the Service that we have not identified or documented.

Nothing in this section is a representation, warranty, guarantee or contractual commitment of any kind — as to the accuracy, completeness or reliability of the Service or its output, as to any level of accuracy being maintained, or as to any particular limitation being documented. Section 9 sets out the legal position and prevails over this section in the event of any inconsistency.

9. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND.

To the fullest extent permitted by applicable law, we disclaim all warranties, conditions and representations, whether express, implied or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, title, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that results obtained from it will be accurate, complete or reliable; that defects will be corrected; or that the Service or the servers that make it available are free of harmful components.

Verify any result before relying on it. No advice or information, whether oral or written, that you obtain from us, from this site or through the Service creates any warranty or representation. These Terms make no express warranty anywhere, and no other section of them is to be read as giving one.

10. Not professional advice

The Service is a general-purpose utility. Its output is not surveying, engineering, legal, cadastral, navigational, safety or regulatory advice, and must not be used as the sole basis for a decision in any of those fields.

Do not rely on the Service for navigation, for establishing legal or property boundaries, for engineering or construction, for emergency or safety-critical purposes, or for any use where an error could cause injury, loss or legal exposure, without independent verification by a qualified professional working from authoritative data.

Where the Service is described as "professional", that refers to the intended audience and the standard we aim for. It is not a warranty, and it does not make the output professional advice.

11. Intellectual property

The Service — including its source code, design, layout, text, graphics, and the "GIS Tools" name and branding — is owned by us or our licensors and is protected by intellectual property laws. All rights not expressly granted are reserved.

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for its intended purpose, subject to these Terms. That licence does not permit you to copy, modify, distribute, sell, lease, reverse engineer or create derivative works from any part of the Service, except to the extent that applicable law expressly permits despite this restriction, or that a separate written licence from us allows.

Third-party components and map data are licensed under their own terms, which prevail over this section as to those components. Map data is © OpenStreetMap contributors, available under the ODbL. The full list and the applicable notices are on the Licenses page.

You keep all rights in the data you process through the Service. We acquire none, because we never receive it.

12. Feedback

If you send us bug reports, feature requests, suggestions or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, without restriction, attribution or compensation. You are not obliged to send feedback, and we are not obliged to act on it or to keep it confidential. Please do not send us anything you regard as confidential or proprietary.

13. Third-party services, links and map data

The Service depends on services we do not control, including OpenStreetMap tile servers, content delivery networks that serve the mapping libraries, and — subject to your cookie choices — Google's analytics and advertising services. It also links to third-party sites, including the tipping service. A link is not an endorsement.

We are not responsible for the availability, content, accuracy, security or practices of any third-party service or site. Your use of them is governed by their own terms and privacy policies and is at your own risk. A third party's change, outage, restriction or withdrawal may degrade or interrupt the Service, and we accept no liability for that.

14. Advertising

The Service is funded by advertising, which is what keeps it free. Ads are shown to all visitors; your cookie choice governs whether they are personalised, not whether they appear. See the Cookie Policy.

We do not select, endorse or vouch for individual advertisers, or for the goods, services or claims in their ads. Any dealing you have with an advertiser is between you and them; we are not a party to it and are not liable for it.

15. Limitation of liability

To the fullest extent permitted by applicable law:

1. We will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profits, revenue, goodwill, business, anticipated savings or opportunity, arising out of or in connection with the Service or these Terms — whether in contract, tort (including negligence), statute or otherwise, and whether or not we were advised of the possibility.
2. This includes, without limitation, loss or damage arising from: any inaccuracy in, or reliance on, output from the Service; loss of data you have not separately backed up; unavailability, interruption or discontinuation of the Service; the acts, omissions or failures of any third-party service; and anything contained in a share link you create or open.
3. Our total aggregate liability arising out of or in connection with the Service or these Terms, however arising, will not exceed the greater of one hundred United States dollars (US$100) or the amount you have paid us in the twelve months before the event giving rise to the claim.
4. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for wilful misconduct, and any mandatory statutory liability. Where an exclusion or limit is found unenforceable, it applies to the maximum extent the law allows.
5. The Service is provided free of charge. This allocation of risk is a fundamental basis of these Terms; we could not offer the Service free of charge without it.

16. Indemnity

To the extent permitted by applicable law, you agree to indemnify us and hold us harmless against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) brought by a third party and arising from: your use of the Service; your breach of these Terms or of any law; the data you process through the Service, including any claim that it infringes a third party's rights or breaches a confidentiality or privacy obligation; or a share link you create or distribute.

We will notify you of any such claim and will not settle it without your consent, which you will not unreasonably withhold. You will not settle a claim in a way that imposes an obligation or an admission on us without our written consent.

This section does not apply to a consumer where, and to the extent that, applicable law does not permit it.

17. Suspension and termination

These Terms apply for as long as you use the Service. You may stop using it at any time.

We may restrict, suspend or terminate your access to the Service, in whole or in part, at any time and without notice, if we reasonably believe you have breached these Terms, or in order to protect the Service, its users, or a third-party service it depends on. Because the Service requires no account, this will usually take the form of a technical block.

Sections 5, 6, 9, 10, 11, 12, 15, 16, 20 and 21 survive termination.

18. Availability and changes to the Service

The Service is offered free of charge and on an "as available" basis. We may change, restrict, suspend or discontinue any part of it — including any feature, format or tool — at any time, with or without notice, and without liability to you.

We are not liable for any failure or delay caused by something beyond our reasonable control, including an outage or change at a third-party provider, a network or infrastructure failure, or any other event we could not reasonably have prevented.

19. Changes to these terms

We may update these Terms. The version published on this page, with the "Last updated" date at the top, is the one that applies. If a change is material we will take reasonable steps to make it apparent on the site — but because the Service has no accounts, we cannot notify you individually.

Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service.

20. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Service (including a non-contractual dispute or claim), are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules.

The competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction, and you and we submit to that jurisdiction. We may nonetheless seek injunctive or other equitable relief in any court of competent jurisdiction in order to protect our intellectual property or the security and integrity of the Service.

If you are a consumer, this section does not deprive you of any protection given to you by the mandatory law of the country where you live, or of any right you have under that law to bring proceedings in your local courts.

21. General

• Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Service, and replace any earlier understanding about it.
• Severability. If a provision is held invalid or unenforceable, it is modified to the minimum extent needed to make it enforceable or, if that is not possible, severed. The rest remains in force.
• No waiver. If we do not enforce a provision, that is not a waiver of it or of our right to enforce it later.
• Assignment. You may not assign or transfer these Terms without our written consent. We may assign them to a successor in connection with a transfer of the Service, provided your rights are not materially reduced.
• No third-party rights. These Terms give no rights to anyone other than you and us.
• No partnership. Nothing in these Terms creates a partnership, agency, employment or joint venture between us.
• Language. These Terms are written in English. If we publish a translation and the versions differ, the English version prevails, except where applicable law requires otherwise.
• Headings. Headings, and the summary at the top of this page, are for convenience only; the numbered terms govern.
